01Who these terms apply to
These Terms of Service govern access to the OrthoPlaniX website and case portal operated by OrthoPlaniX Treatment Planning (“OrthoPlaniX”). By creating an account or submitting a case you agree to them on behalf of yourself and the practice, laboratory or company you represent.
OrthoPlaniX is a business-to-business service for licensed dental professionals, dental laboratories and aligner companies. It is not available to patients or consumers.
02Our service
OrthoPlaniX prepares digital clear-aligner treatment plans — 3D setups, staging, attachment and IPR proposals — from the scans, photographs, radiographs and prescription supplied by the submitting professional. Plans are delivered through the portal for review, revision and approval.
Turnaround times published on the website are targets, not guarantees. They start when a complete, readable case has been received.
03Clinical responsibility
OrthoPlaniX provides technical planning support only. Every plan is a proposal. The treating clinician remains solely responsible for diagnosis, treatment decisions, patient consent, reviewing and approving each plan, and for the outcome of treatment. Nothing in the service constitutes the practice of dentistry or medical advice to any patient.
04Your account
- You must be a licensed dental professional or authorised representative of a dental business, and provide accurate account details.
- Keep your credentials confidential; you are responsible for activity under your account. Tell us immediately if you suspect unauthorised access.
- We may suspend or close accounts that breach these terms, are used fraudulently, or remain unpaid.
05Case submissions and patient data
- You confirm you have the lawful basis and any consents required to share patient data with OrthoPlaniX as your processor / service provider.
- Submit de-identified patient references (initials + chart number) rather than full names wherever possible.
- You grant OrthoPlaniX a limited licence to use submitted files solely to deliver the requested planning service.
- OrthoPlaniX processes case data according to the Privacy Policy and, where required, a data-processing agreement.
06Fees and payment
Fees are shown on the Pricing page or agreed in writing for lab and enterprise accounts. Invoices are issued per case (or per plan period) and are payable through the portal via Razorpay or PayPal, or by another agreed method. Final plan files may remain locked until the related invoice is paid. Promotional offers such as a free first case are subject to fair-use limits of one per practice.
07Intellectual property
You own your patient records and submitted files. On payment, you receive a perpetual licence to use the delivered treatment plan for the treatment of the patient it was prepared for. OrthoPlaniX retains ownership of its methods, templates, software and know-how. The website, brand and content are protected by copyright and may not be copied without permission.
08Acceptable use
- Do not upload content you have no right to share, malware, or data unrelated to a legitimate case.
- Do not attempt to access other users’ cases, probe or disrupt the platform, or reverse-engineer the service.
- Do not use the service for direct-to-consumer aligner supply without appropriate clinical oversight.
09Confidentiality
Each party will keep the other’s non-public information confidential and use it only for the purposes of the service. OrthoPlaniX will not disclose your case volumes, pricing or clinical preferences to third parties except as needed to deliver the service or as required by law.
10Disclaimers and limitation of liability
The service is provided with reasonable skill and care. To the fullest extent permitted by law, OrthoPlaniX excludes all implied warranties and is not liable for indirect or consequential loss, loss of profit, or for clinical outcomes, which remain the responsibility of the treating clinician. Our total liability for any claim arising from the service in a 12-month period is limited to the fees paid by you for the service in that period. Nothing limits liability that cannot be limited by law.
11Termination
You may close your account at any time. Outstanding invoices remain payable. We may terminate or suspend access for material breach, non-payment or legal necessity. Sections on clinical responsibility, intellectual property, confidentiality and liability survive termination.
12Governing law and changes
These terms are governed by the laws of [Governing law jurisdiction — EDIT HERE], without prejudice to mandatory consumer or professional regulations in your jurisdiction. We may update these terms; continued use after the “last updated” date constitutes acceptance. Contact: hello@orthoplanix.com.
